1.5px;">●</span>培训机构设置应当适应本地经济和社会发展需要，符合教育、文化、科技、体育事业发展和人民群众需求，贯彻党的教育方针，遵守国家法律法规，遵循教育教学规律和中小学生身心发展规律，坚持社会主义办学方向，坚持立德树人，坚持教育公益属性，坚守安全底线，切实保障师生身心健康。</span></p><p style="margin-top: 16px;color: rgb(0, 0, 1.5px;">●</span>文化和旅游部门、科技部门、体育部门分别为文化艺术类、科技类、体育类培训机构的主管部门，应发挥专业优势，按照“谁主管、谁审批、谁负责”的原则，全面履行培训机构的审核审批和日常监管、平台监管及违法违规行为查处等职责。</span></p><p style="margin-top: 16px;color: rgb(0, 0, 0);font-size: 1.5px;">●</span>培训机构举办者应是国家机构以外的社会组织、企业或者自然人，并符合相关条件。中小学校（园）及其在职教职工不得举办或参与举办培训机构。</span></p><p style="margin-top: 16px;color: rgb(0, 0, 0);font-size: medium;line-height: 1.75em;"><span 1.5px;">●</span>设立培训机构应具有与培训类型、层次、规模相适应的资金投入、经费来源和固定场所。同一培训时段内，生均面积不低于3平方米。不得选用居民住宅、半地下室、地下室、违章建筑及其他存在安全隐患的场所。不得在中小学校（园）内举办培训机构。</span></p><p style="margin-top: 16px;color: rgb(0, 0, 0);font-size: 1.5px;">●</span>培训机构应根据所开设培训项目及规模配齐具有相应任职资格和任职条件的专兼职从业人员。培训机构不得聘请在境外的外籍人员开展培训活动。培训机构应对拟招用人员和劳务派遣单位拟派遣至机构培训场所工作的人员进行性侵等违法犯罪信息查询。</span></p><p style="margin-top: 16px;color: rgb(0, 0, 0);font-size: 1.5px;">●</span>培训机构经审批取得办学许可证、营业执照或民办非企业单位登记证书后，应通过平台完成注册，实施“实名制”管理，如实登记培训项目、培训内容、培训材料、培训教员、培训学员等信息，开设资金监管账户，使用平台上架、售卖课程及退费，自觉接受主管部门线上监管。</span></p><p style="margin-top: 16px;color: rgb(0, 0, 1.5px;">●</span>培训机构开展的培训活动不得与当地中小学校（园）教学时间相冲突，线下培训结束时间不得晚于20:30，线上培训结束时间不得晚于21：00。不得对升学、通过考试或培训效果作出明示或暗示的保证性承诺；不得在主流媒体及其新媒体、网络平台、公共场所、居民区刊登、播发培训广告；不得在中小学校（园）内开展商业广告活动；不得以暴力、威胁等手段强迫学生接受培训。</span></p><p 1.5px;">●</span>培训机构应与学员签订培训合同，规范使用《中小学生校外培训服务合同（示范文本）》，并按照相关规定开具正式收费票据。不得在公示的项目和标准外收取其他费用，不得使用“培训贷”等违规方式收取培训费用，不得向学生及家长售卖资料、书籍、辅助工具、器材等商品，也不得强制或变相强制学生及家长购买；不得一次性收取或变相收取时间跨度超过3个月或60课时的费用，且不得超过5000元。</span></p><p
