定金具有担保合同履行的性质，而订金只是一个习惯用语，并非法律概念，不具有担保的功能。只要当天用厅不冲突，人家增加了人数，能换大的肯定要和另一边客人协商啊。大家都是办喜事，只要不影响容纳客人人数，我相信绝大多数客人都是通情达理的！ 其实他 直接起诉就可以了 看看法院怎么裁定 大家说了都不算
双方都有过失，还是自己协商吧 既然可以将两万元定金转成会员卡消费，那就说明并没有因为已经使用这笔钱进行了食材的采买而不能退款。再说还有大半个月才到婚宴时间，不可能提前这么久买食材。唯一可以站的住脚的说法就是因为被预订造成了这个厅无法再预订给别人而造成了酒店的损失，目前时间临近婚期不到一个月，再次预订出去的可能性不大，相当于一方违约，可以扣除违约金后进行退款。至于扣除多少违约金就看双方怎么协商了。 这个吧，我记得定金这东西，退不了。所以现在看字眼很重要了呀。
